ICC Prosecutor Seeks Arrest Warrants
ICC Prosecutor Karim A.A. Khan KC has filed applications for arrest warrants against Israeli and Hamas leaders for war crimes and crimes against humanity committed from October 7, 2023, onwards. This action comes amidst the ongoing Israeli-Palestinian conflict, which has seen significant loss of life and alleged humanitarian violations by both sides.
The submitted applications target high-profile figures including Yahya Sinwar, Mohammed Diab Ibrahim Al-Masri (Deif), Ismail Haniyeh from Hamas, and Israeli officials Benjamin Netanyahu and Yoav Gallant. The accusations against the Hamas leaders include extermination, murder, taking hostages, rape, torture, and other inhumane acts. Conversely, Israeli officials are accused of starvation of civilians, wilful killing, and attacks on civilian populations.

Investigating Serious Allegations
The crimes are alleged to be part of a widespread and systematic attack against civilian populations by both Hamas and Israeli forces. This investigation follows evidence from various sources including victims, survivors, CCTV footage, authenticated media, and expert testimonies.
“International law and the laws of armed conflict apply to all. No foot soldier, no commander, no civilian leader – no one – can act with impunity. Nothing can justify willfully depriving human beings, including so many women and children, the basic necessities required for life. Nothing can justify the taking of hostages or the targeting of civilians,” per ICC Prosecutor Karim A.A. Khan KC.
The ICC has emphasized the need for equal application of international humanitarian law and has called for the immediate release of all hostages and full compliance with international humanitarian law. The prosecutor’s office has indicated that the investigation is ongoing and could result in additional arrest warrants if further evidence meets the threshold for conviction. The principle of complementarity will be assessed to ensure that national authorities conduct independent and impartial judicial processes.

Diverse Reactions to ICC’s Move
Strong reactions have followed the ICC’s initiative. Prime Minister Netanyahu has rejected the comparison between Israel and Hamas with disgust, while US figures like President Joe Biden and Secretary of State Antony Blinken have also criticized the ICC’s move, asserting that the court lacks jurisdiction over the matter. Furthermore, Israel’s Foreign Minister Israel Katz condemned the ICC’s applications as an attack on the victims of the October 7 attacks and established a special command center to challenge the decision.
Joe Biden, the US president, described the move as “outrageous” in a statement, adding: “Whatever this prosecutor might imply, there is no equivalence – none – between Israel and Hamas. We will always stand with Israel against threats to its security.”
Hamas has demanded the cancellation of all arrest warrants against their leaders, criticizing the timing and intention behind the ICC’s actions. This comes after the October 7 Hamas attack on Israel, which resulted in approximately 1,200 Israeli deaths and has since seen significant casualties in Gaza. The international community remains divided, with some seeing the ICC’s actions as a necessary step towards accountability, while others view it as an overreach.
We fundamentally reject the announcement from the @IntlCrimCourt Prosecutor that he is applying for arrest warrants for senior Israeli officials together with warrants for Hamas terrorists.

The Role of the ICC Moving Forward
The International Criminal Court, established in 2002, prosecutes war crimes, crimes against humanity, genocide, and aggression. Despite its efforts, many countries including Israel and the United States, do not recognize its jurisdiction. In 2020, then U.S. President Donald Trump sanctioned ICC prosecutors investigating U.S. troops, though these sanctions were later lifted by President Biden in 2021. The current probe will continue to garner global attention as its outcomes could reshape perceptions and actions concerning international law and conflict resolution.
ICC Prosecutor Karim A.A. Khan KC went on to say, “It is the view of my Office that these individuals planned and instigated the commission of crimes on 7 October 2023, and have through their own actions, including personal visits to hostages shortly after their kidnapping, acknowledged their responsibility for those crimes. We submit that these crimes could not have been committed without their actions. They are charged both as co-perpetrators and as superiors pursuant to Articles 25 and 28 of the Rome Statute.”
Future developments will depend on the decisions of ICC judges, who will need to determine if the presented evidence is sufficient to issue arrest warrants, a process that could take several weeks or months. The pursuit of justice in such a deeply entrenched conflict aims to set a precedent for accountability at the international level.
