Airline Sued For Overserving Alcohol

(Newsworthy.news) – A wrongful death complaint has been filed against Delta Airlines by the estate of a female whose husband was allegedly overserved liquor before he ran her down in an airport parking lot in Utah.

A lawsuit that was filed by the representatives of the estate of Charlotte Sturgeon and her child, who was present during the horrific accident. It claims that the airline is responsible for her demise because its staff served Shawn Sturgeon two additional drinks even though he had already consumed a number of alcoholic beverages before boarding the plane.

On April 4, 2022, Shawn was allegedly so drunk from the beverages the crew gave him that he could not recall landing or finding his way to the car, a degree of impairment that exceeds the legal legal blood-alcohol limit, according to the lawsuit.

Shawn allegedly got into a heated argument with his wife, according to criminal court documents. Shawn hopped into the driver’s seat of the SUV and accelerated, pinning Charlotte, who was standing outside the open rear door with her child inside and sending her tumbling beneath the car. Security video shows he drove over his wife before coming to a halt.

After getting out of the vehicle, Shawn berated his wife, asking her if she was going insane and telling her to get up immediately. He loaded her into the vehicle and headed to the toll station for assistance.

Charlotte was pronounced dead at a hospital after being unconscious upon police arrival.

On September 9, 2022, Judge Paul B. Parker of the Third District Court handed down a sentence to Shawn Sturgeon (38) of West Jordan, up to a maximum of 20 years in Utah State Prison. Sturgeon pled guilty to one count of second-degree vehicular homicide, one count of third-degree domestic violence in the vicinity of a child, and one count of criminal negligence involving driving under the influence of alcohol or drugs.

Shawn was visibly drunk as he stepped off the aircraft, but Delta staff did nothing to prevent him from getting behind the wheel or notify the authorities, according to the lawsuit.

The lawsuit also said that Sturgeon’s child is now experiencing psychiatric sickness and emotional hardship.

Although Delta disputes the charges in the case, they are unable to comment more due to the ongoing litigation, according to a statement released by Delta this week.
